Copyright Policy

Send copyright notices and counter-notices to our designated agent:

Filing a copyright notice

To be valid, a notice must include all of the following:

1. Identification of the copyrighted work you claim has been infringed.
2. Identification of the material you claim is infringing and where it appears on Modest Kouture (the listing or storefront URL).
3. Your name, mailing address, telephone number, and email address.
4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
5. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
6. Your physical or electronic signature.

Knowingly misrepresenting that material is infringing can make you liable for damages under 17 U.S.C. §512(f).

What happens next

When we receive a valid notice we promptly remove or disable access to the material: the listing is placed on hold so it no longer appears on the storefront and the seller cannot republish it. We notify the seller, give them a copy of the notice, and tell them how to respond.

Counter-notice (for sellers)

If your listing was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the agent above. It must include:

1. Identification of the material that was removed and where it appeared.
2. A statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification.
3. Your name, mailing address, and telephone number.
4. A statement that you consent to the jurisdiction of the federal district court for the district where your address is located (or, if outside the United States, any district in which Modest Kouture may be found), and that you will accept service of process from the person who filed the original notice.
5. Your physical or electronic signature.

We forward a valid counter-notice to the person who filed the original notice. Unless they tell us within 10 business days that they have filed a court action to keep the material down, we may restore it 10 to 14 business days after we receive your counter-notice.

Repeat infringers

Sellers who are the subject of repeated valid copyright notices lose their selling privileges, and accounts of repeat infringers are terminated. Sellers agree to this policy through our Seller Guidelines and Terms of Service.

Trademarks and other rights

Complaints about trademark misuse, counterfeit goods, or other intellectual property can be sent to the same agent, or reported from the listing with the "Report this listing" link.
